This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for interim bail on the ground of ailment of the mother of the petitioner. Some medical documents have been annexed to the main bail application as Annexure-5 series.
As per the order dated 31.03.2022, learned counsel for the State was asked to obtain instruction on the interim application.
Today, learned counsel for the State has furnished the written instruction received from the Deputy Superintendent of Police, SIP, CID-CB, Bhubaneswar dated 08.04.2022, from which it reveals that the mother of the petitioner has undergone with a
// 2 // number of medical check-ups at SUM Hospital, Bhubaneswar in the month of December 2021 and she was not detected with any severe health complications. The written instruction further reveals that the father of the petitioner, who is a retired Army personnel and is serving as a Training Instructor at the S.O.G. (Special Operation Group) Battalion, Chandaka, Bhubaneswar, is also capable enough to take care of the well-being of his wife in case of necessity. The written instruction is taken on record. In view of the instruction received by the learned counsel for the State, I am not inclined to grant interim bail to the petitioner.
Accordingly, the prayer for interim bail stands rejected.
The I.A. stands disposed of.

Learned counsel for the petitioner submitted that some of the co-accused persons similarly situated have been released on bail and therefore, the petitioner may be permitted to withdraw this bail application with liberty to renew his prayer for bail in the Court below.
With the aforesaid liberty, the BLAPL stands
// 3 // disposed of as withdrawn. It is observed that in the event the petitioner moves an application for bail, the claim of parity shall be taken into account.
