Heard Mr. A.C. Behera, learned counsel for the petitioners and Mr. H.M. Dhal, learned Additional Government Advocate. 2.

According to Mr. Behera, though the forefathers of the petitioners, who belong to Scheduled Tribe were displaced on account of construction of Machhakund Hydro Electric Power Project and though according to the rehabilitation policy in force at that point of time, they were entitled to get land to the tune of five acres per family however, they were never extended with such benefits as a result of which the present petitioners are suffering a lot.

During course of hearing, Mr. Behera submits that liberty may be granted to the petitioners to approach the Collector & District Magistrate, Malkangiri (opposite party No.4) in the matter by filing representation and the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without

// 2 // expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file individual representations before the Collector & District Magistrate, Malkangiri (opposite party No.4) through registered post within a period of four weeks from today. In the event, such representations are filed along with copy of this order, the opposite party No.4 is directed to take a decision on the same in accordance with law within a period of six months from the date of receipt of such representations and communicate the result of such exercise to the petitioners.

Accordingly, this writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application.
