1. This matter is taken up through Hybrid mode. Order No.

2. Heard.

3. This application under Section 482 Cr.P.C. has been filed by the Petitioner for quashment of the order dated 5.11.2007 passed by the learned S.D.J.M., Nayagarh in ICC Case No.130 of 2007 wherein the learned S.D.J.M has taken cognizance under Sections 323/294/34 IPC against him.

4. Considering the facts and the submissions made, this Court is not inclined to interfere with the impugned order.

5. However, this Court directs that if the Petitioner has not been released on bail and if he surrenders before the Court in seisin over the matter within six weeks hence and makes a motion for bail, the Court in seisin over the matter shall release him on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper.

6. With the aforesaid order, this CRLMC stands disposed of.

7. Interim order passed earlier stands vacated. This order be communicated to the trial court immediately.

8. Urgent certified copy of this order be granted on proper application.
