Heard learned counsel appearing for the parties. Order No.

This writ petition involves the following prayer: "That the petitioner therefore prays that your Lordships graciously be pleased to admit the writ application and issue a rule NISI to the Opp. Parties to show cause as to: 1) Why the Opp. parties will not be directed to clear the dues as per Annexure 1 & 2 within a stipulated period; And if the Opp. parties do not show cause then the rule be made absolute by issuing appropriate writ(s) or order/direction as deem fit be passed;

And for this act of kindness the petitioner shall as in duty bound ever pray."

This Court finds the writ petition involves cause of action involving a Contractor making demand for release of dues on completion of contractual work. There is no counter affidavit filed by the opposite parties.

Considering the writ petition was filed in 2004 and learned counsel for the petitioner has also no instruction as to whether there is any attaining to the claim of the petitioner in the meantime, this Court dismisses the writ petition for no instruction however with liberty to the

// 2 // petitioner to reopen the matter in the event any such cause of action still survives.
