1. As far as the Opposite Party No.3 is concerned, Mr. S.S. Rao, learned counsel for the Petitioner points out that he being not a party to the arbitral dispute itself, therefore service of notice on him is not mandatory.
2. As regards the main dispute, the contesting party is the Union of India and they do not have any objection to the appointment of an Arbitrator to resolve the dispute between the parties.
3. In that view of the matter and with the consent of the parties, the Court appoints Mr. Justice Pramath Patnaik, former judge of this Court, as sole Arbitrator to conduct the arbitration proceedings and adjudicate the disputes between the parties including their claims and counter claims. The arbitration proceedings shall take place under the aegis of the High Court Arbitration Centre. A copy of this order be communicated to the learned Arbitrator as well as the Coordinator, Arbitration Centre forthwith.
4. The arbitration petition is disposed of.
