This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned State counsel.

The petitioner is an accused in 2(a)C.C. Case No.04/2020(N) on the files of learned Additional Sessions Judgecum-Special Judge, Chatrapur, Ganjam, arising out of Ganjam P.R. Case No.43 of 2020-2021, under Sections 20(b)(ii)(c) and 8 of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judgecum-Special Judge, Chatrapur, Ganjam, by order dated 04.01.2021, in the aforementioned case, the present BLAPL has been filed.

By order dated 09.11.2021 in I.A. No.1093 of 2021 this Court has granted interim Bail to the petitioner with the stipulation that he shall surrender on expiry of the interim bail period on 06.12.2021.

The petitioner did not surrender and moved an application for extension of interim bail which was rejected by order dated 02.12.2021 in I.A. No.1251 of 2021. 7.

In such view of the matter, since the petitioner has failed the trust of this Court, this BLAPL stands dismissed. 8.

The learned counsel for the petitioner submits that he has no instruction as to the present status and petitioner might have surrendered in the meanwhile. In view of the order dated 02.12.2021, rejecting the petition for extension by this Court, no further lenience can be shown to the petitioner. 9.

The superintendent of Police Ganjam, is directed to take steps for apprehension of the accused, if in the meantime he has not surrender 10.

The BLAPL accordingly stand disposed of.

Urgent certified copy of this order be granted as per rule.
