1. This matter is taken up through hybrid mode.

2. The petitioner has filed writ petition seeking to quash the order dated 18.09.2013 in Annexure-1, and to issue direction to the opposite parties to refund the EMD amount of Rs.2,44,100/- to the petitioner in respect of Bid No. SE.CTC.(R & B) 6/2013-14.

3. In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to the opposite party No.2 vide Annexure-8, and the same may be directed to be disposed of within a stipulated time, to which learned State Counsel has raised no objection.

4. As agreed by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party No.2 to consider the representation filed by the petitioner vide Annexure-8, and pass

// 2 // appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

5. The interim order dated 09.10.2013 passed in Misc. Case No.21376 of 2013 stands vacated.
