This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No.623 of 2020 arising out of Baghamari P.S. Case No. 55 of 2020 on the file of learned SDJM, Khurda, registered for the alleged commission of offence under Sections 458/395 of the I.P.C. read with Section 25 of the Arms Act and Sections 3/4 of the E.S. Act 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Khurda by order dated 23.12.2020, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that similarly situated co-accused persons, namely, Sukanta Behera, Anil Kumar Sahoo, Ratnakar Sahoo and Bhaina @ Bidesi

@ Dillip Das have been released on bail by order dated 1.09.2021 passed in BLAPL No.6861 of 2021 and by order dated 15.10.2020 passed in BLAPL No.5971of 2020, order dated 16.10.2020 passed in BLAPL No.5972 and order dated 16.11.2021 passed in BLAPL No.8051 of 2020 respectively other co-accused similarly placed have been released on bail.

Considering the submissions made, the petitioner is directed to be released on bail on such terms to be fixed by the learned Court in seisin over the matter with additional stipulation that he shall appear in person before the jurisdictional Police Station once every ten days till conclusion of the trial. 7.

Violation of any of the above condition(s) shall entail cancellation of bail by the learned court in seisin over the matter without any further reference to this Court.

Accordingly, the BLAPL stands disposed of.
