01. 1. This matter is taken up through Virtual Mode.
2. The petitioner being an unsuccessful aspirant for award of five years lease in respect of Jambhira Sand Quarry, Stretch No.3, has filed the present writ petition challenging the action of the Tahasildar, Morada, District-Mayurbhanj-Opposite Party No.3 in awarding the same to Amulya Kumar Behera-Opposite Party No.4 by ignoring the better claim of the petitioner.
3. After arguing for some time, learned counsel for the petitioner prays for permission to withdraw the writ petition to enable his client to seek the alternative remedy of appeal provided under Rule 46 of the Odisha Minor Mineral Concession Rules, 2016.

4. The writ petition is accordingly dismissed as withdrawn with the aforesaid liberty.
5. As the restrictions due to resurgence of COVID19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
