Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Chandipur P.S. Case No.91 of 2021 corresponding to C.T. Case No.970 of 2021 pending in the Court of learned S.D.J.M., Balasore for alleged commission of offences under sections 272/273/34 of the Indian Penal Code read with section 52(a) of Odisha Excise Act.
Learned counsel for the State submitted that
// 2 // the petitioner has got number of criminal antecedents. In view of available material on record particularly the criminal antecedents against the petitioner, while not inclining to grant anticipatory bail to the petitioner, I direct that in the event petitioner surrenders and moves for bail before the learned Court below within a period of four weeks from today, the same shall be disposed of as expeditiously as possible in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case diary be made available before the Court concerned for disposal of the case.
The ABLAPL stands disposed of.
