Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 21.09.2021 in connection with Loisingha P.S. Case No. 188 of 2009 corresponding to G.R. Case No. 188-B of 2009 pending in the Court of learned Additional Sessions Judge, Bolangir for the alleged commission of offence under Sections 147/148/294/323/307/302/149 of IPC. 4.

The petitioner was an absconder and was arrested nearly twelve years after the occurrence. In the original trial, all other accused persons were convicted and sentenced appropriately for the alleged offences. The petitioner stands on the same footing. 5.

Considering the nature of allegations and the above facts, I am not inclined to allow the prayer for bail, which is therefore, rejected. However, considering the fact that the case is the year

2009. It is directed that learned court below shall do well to try and conclude the trial as early as possible, preferably within a period of two months, since it is submitted that only two more witnesses remain to be examined. It shall be open to the petitioner to renew his prayer, if trial is concluded within the aforesaid period. 6.

The BLAPL is accordingly rejected.
