1. During the pendency of the present petition which challenges an order dated 4th December, 2008 passed in O.A. No.554 of 2005 by the learned Central Administrative Tribunal, Cuttack Bench, Cuttack, there has been no stay of the said impugned order.

2. Further appears that the Petitioner Railways in fact implemented the impugned order, whereby the Opp.Party was granted promotion subject to the outcome of the present petition.

3. The Respondent is already 58 years old now and is close to retirement. In that view of the matter, leaving the questions of law arising from the impugned order of the CAT open for consideration in some other case, the writ petition is disposed of.
