The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 21.08.2010 passed by the learned S.D.J.M., Bhubaneswar in 1.C.C. Case No.2666 of 2010 sending the complaint petition under Section 156(3) of Cr.P.C. to the I.I.C., Chandrasekharpur Police Station for registration of a P.S. Case and took up investigation. 3.

Heard the learned counsel for the petitioner and the learned counsel for the State.

Considering the facts and circumstances of the case, so also the submission advanced on behalf of the learned counsel

// 2 // for the petitioner, this Court is not inclined to interfere with the impugned order.

Hence, giving liberty to the petitioner to file appropriate petition before the appropriate forum, if in the meanwhile F.I.R. has been registered pursuant to the impugned order, chargesheet has been filed and cognizance has been taken, this CRLMC stands disposed of being dismissed. Interim order dated 02.02.2011 passed by this Court stands vacated. 6.

A copy of this order be communicated to the Court below forthwith.
