This matter is taken up through Hybrid mode.

This CMP has been filed assailing order dated 12th March, 2014 (Annexure-1) passed by learned Civil Judge (Senior Division), Jaleswar, whereby an application under Order VI Rule 17 CPC filed by the Plaintiff/Petitioner was rejected.

The matter was listed on 30th June, 2022 for consideration of IA No.136 of 2020 filed with a prayer for extension of interim order dated 4th April, 2014 passed in Misc. Case No.353 of 2014. Mr. Rath, learned counsel for the Petitioner, however, submitted that the aforesaid IA No.136 of 2020 was not filed by him. He further submitted that the Petitioner might have engaged any other counsel and he submitted for adjournment to take instruction in the matter.

Today, Ms. Das, learned counsel for the Petitioner files a memo stating that in spite of communication no instruction from the Petitioner is received. She therefore prays for passing appropriate order.

Mr. Bose, learned counsel for Opposite Party Nos.9, 10, 11, 15 & 16 is present.

In view of the submission made by learned counsel for the Petitioner and memo filed to that effect, the CMP is dismissed for non-prosecution.
