7. 1. This matter is taken up by hybrid mode.

It is submitted by the learned counsel for the petitioners that after the order dated 16.03.2022 passed by this Court regarding applicability of Rule-25(3) of the Odisha Education (Establishment, Recognition and Management of Private Colleges) Rules,1991, further developments have taken place which has the impact of rendering infructuous the first prayer in the writ petition, i.e., to quash the order dated 20.12.2021 (Annexure-6) by which the earlier Governing Body was continuing.
3. Learned counsel for opposite party nos.4 to 13 submits that he has filed counter which is on record.

It is submitted by the learned counsel for the petitioner and also agreed by the learned Standing Counsel as well as learned counsel for the opposite party no.14 that by office order of the Director of the Higher Secondary Educationopposite party no.2 dated 06.05.2022 (copy of which is filed in Court today and taken on record), the Governing Body constituted by order dated 21.12.2021 has been superseded and an Authority, i.e., Tahasildar,
// 2 // Nimapara has been appointed as Special Officer in respect of the Institution.

In view of the above, the first part of the prayer no more survives.

Regarding second prayer in the writ petition, the authority is directed to take a decision within four months in accordance with law, regarding reconstitution of the Governing Body by giving opportunity of hearing, particularly to the parties in the present writ petition.
