This application under Section 482 Cr.P.C. has been filed by the Petitioner for quashment of the order dated 05.08.2011 passed by the learned S.D.J.M., Koraput in ICC No.20 of 2011 wherein the learned S.D.J.M has taken cognizance for commission of the offence under Section 138 of the N. I Act against him.

Learned counsel for the Petitioner submits that he has no instruction in this matter.

In such view of the matter, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Accordingly, this CRLMC stands dismissed for nonprosecution. 6.
