This RPFAM has been filed assailing the judgment and order dated 24th October, 2009 passed by learned Judge, Family Court, Rourkela in Criminal Proceeding No.57 of 2008. 3.

Office note indicates that notice issued to the Opposite Party Nos.1 and 2 by registered post with A.D. returned unserved with a postal remark "wrong address" No step for issuance of fresh notice has been taken. On perusal of the order sheet, it appears that on the last occasion, i.e. on 31st July, 2019, none had appeared on behalf of Opposite Parties, when the matter was called.

Mr. Nayak, learned counsel appearing on behalf of Mr. Sarangi, learned counsel for the Petitioner submits that he has no instruction in the matter.

Accordingly, the RPFAM is dismissed for nonprosecution.
