1. The Petitioner, who was the purchaser of the land in question from the original lessee, questions the impugned order dated 30th June, 1998 passed by the Additional District Magistrate, Bhubaneswar in R.C. Case No. 630 of 1998 on the short ground that the said order which cancels the lease in favour of his vendor was passed without giving the Petitioner a hearing.
2. On the above short ground, which has not been contested by filing any reply, the impugned order is set aside and Revision Case No.630 of 1998 is restored to the file of the ADM, Bhubaneswar. The Petitioner will appear before the ADM, Bhubaneswar on 25th April, 2022 along with a downloaded copy of this order. The ADM, Bhubaneswar will after hearing the Petitioner and any other party who may have an interest in the land in question, pass a reasoned order afresh within a period of four months thereafter. Till such time the status quo order passed
// 2 // by this Court on 1st December, 2011 will continue. Since Opposite Party No.5 i.e. the original lessee was unable to serve the present proceeding, the ADM will require to take appropriate steps in that regard in those proceedings.
