This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to set aside the order dated 24th September, 2009 passed by the learned J.M.F.C., Salipur in G.R. Case No.759 of 2007 with a direction to the Opposite Party No.8-Superintendnet of Police (Rural), Cuttack to further investigate into the matter in accordance with law.

It appears the Petitioner was reported that the case to be a mistake of fact. Thereafter, the Petitioner made a prayer before the learned J.M.F.C., Salipur to send the case under Section 156(3) of Cr.P.C. for further investigation by higher
// 2 // authorities. The same was rejected by the learned Magistrate vide the impugned order which has been challenged in this petition.

No one appears on behalf of the Petitioner when the matter is called. But, Mr. Soura Chandra Mohapatra, learned counsel through his junior represents Opposite Parties No.2 to 6.
