This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioners with a prayer to quash the order dated 25th March, 2010 passed by the learned Additional Sessions Judge (Fast Track), Aska in S.T. No.32 of 2009 & S.T. No.17 of 2010, corresponding to G.R. Case No.114 of 2008, arising out of Aska P.S. Case No.83 dated 28th March, 2008, wherein charge under Sections 302, 307, 326, 109, 120-B of the I.P.C. read with Sections 25 & 27 of the Arms Act thereby discharging them from the said charges.

No one appears on behalf of the Petitioners when the matter is called. However, learned counsel for the StateOpposite Party is present. 4.

The case is of the year 2011.

As such, this Court is of the view that the Petitioners are recalcitrant litigants and do not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 7.

Interim order dated 19th April, 2011 passed by this Court in Misc. Case No.740 of 2011 stands vacated. 8.

Order be communicated to the court concerned forthwith.
