The present contempt has been filed for the Order No.

alleged violation of the order dated 02.08.2012 passed in W.P.(C) No.196 of 2010. The operative portion of which reads as under:

" Let the Anenxures be supplied by the petitioner to be utilized by the Tahasildar to reconstruct the file and take a decision within a period of three months from today. If the land applied for by the petitioner is not available, he shall be considered for any other land available in adjacent village.

The writ application is accordingly disposed of.

A free copy of this order be handed over to the learned counsel for the State."

Mr. Samantaray states that pursuant to the aforesaid directions, the Tahasildar, Bhubaneswar has passed a speaking order dated 07.07.2014 in Waste Land Lease Case No.166 of 2000 which is a subject matter of challenge by the petitioner in W.P.(C) No.15866 of 2014.

Keeping in view the nature of the dispute and time taken for restructuring the file, we condone the delay in implementing the order.

In view of the above, it is conceded by the learned counsel for the parties that the present contempt has been rendered infructuous.

The CONTC is accordingly dismissed as infructuous.
