Petitioner in this RPFAM seeks to assail the order dated 12th August, 2008 (Annexure-1) passed by learned Judge, Family Court, Cuttack in CRP No.279 of 2006, whereby the Petitioner has been directed to pay maintenance at the rate of Rs.1,500/- per month to Opposite Party-wife from the date of application, i.e., 12th May, 2006.

Vide order dated 26th November, 2009, this Court directed for issuance of notice to the Opposite Party, but due to non-filing of requisites, notice could not be issued, as yet. 4.

Learned counsel for the Petitioner submits that he has lost the brief and prays for an adjournment.

Since no step has been taken pursuant to order dated 26th November, 2009 till date, this Court does not feel it appropriate to adjourn the matter.
