State Of Orissa v. Panu@Ajaya Singh
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLLP No.102 of 2015 State of Orissa ......... Petitioner Mrs. Saswata Pattnaik, AGA -Versus- Panu @ Ajaya Singh ........
Opp. Party
CORAM:
JUSTICE C.R. DASH JUSTICE SAVITRI RATHO
ORDER
04.03.2022 Order No.
04.
1.
This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2.
Heard.
3.
This petition has been filed by the State seeking leave to appeal. Admittedly, the deceased died of suicidal hanging. Though a suicidal note was recovered lying on the body of the deceased, the hand writing expert has opined that, the hand writing is not that of the deceased.
4.
Mrs. Saswata Pattnaik, learned Addl. Government Advocate submits that, the father of the deceased has testified about the demand of dowry.
5.
Having perused the impugned judgment, in our merited consideration, learned Sessions Judge, Baleswar has very clearly eschewed such evidence recorded in the order of acquittal. We, therefore, do not find any ground to interfere in the matter. Accordingly, the leave sought for is rejected. 6.
The CRLLP is dismissed.
