This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the proceeding initiated by the Opposite Party under Section 138 of the N.I. Act in I.C.C. Case No.857 of 2011 pending in the Court of J.M.F.C., Bhubaneswar.

No one appears on behalf of the Petitioner at the time of call.

The case is of the year 2011 and also last listed on 16th December, 2011.

In such view of the matter, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution.
