This matter is taken up through Hybrid Arrangement (Virtual/ Physical Mode).

Heard Mr. Krushna Chandra Dash, learned counsel for the Appellant and Mr. Nilambar Jena, learned Standing Counsel for the School & Mass Education Department.

The Appellant is stated to have filed a representation before the District Education Officer, Jajpur vide Annexure-4. Before the Single Bench, the petitioner submitted that, he wishes to move the authority for redressal of his grievances instead of pursuing the present litigation. Accordingly, the writ petition was disposed vide order No.1, dtd. 21.12.2021.

Learned Counsel for the appellant submits that, his representation vide Annexure-4 of the writ petition be disposed of

in accordance with law by the District Education Officer, Jajpur, present Opposite Party No.3.

Regard being had to the facts and submissions and the nature of relief sought for, though we do not find any infirmity in the order passed by the learned Single Judge, we clarify the order to the extent that, the petitioner, if so advised, may pursue the remedy in the matter by pressing his representation vide Annexure-4 and such representation vide Annexure-4 should be disposed of by the District Education Officer, Jajpur (Opposite Party No.3) within a period of three months hence in accordance with law by passing a reasoned order.

The writ appeal is accordingly disposed of.

Urgent certified copy of this order be granted as per rules.
