This matter is taken up through hybrid arrangement (virtual/physical mode).

The defaulting borrower has filed the present writ petition assailing the recovery process initiated by the Bank by issuance of a Demand Notice dated 28th June, 2014 under Section 13(2) of the SARFAESI Act, 2002 for recalling of the outstanding amount of around Rs.60 lakhs in two loan facilities availed, apart from facing execution proceedings pursuant to an award passed in arbitration proceedings.

At the time of hearing, learned counsel for the parties are agreed that the present writ petition has become infructuous in view of both the loan accounts having been settled and closed.

In view of the above, the present Writ Petition is dismissed as infructuous.
