This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order taking cognizance dated 20th September, 2010 passed by the learned S.D.J.M., Berhampur in G.R. Case No.488 of 2007. 3.
No one appears on behalf of the Petitioner at the time of call.

Hence, the CRLMC stands dismissed for nonprosecution. 5.
However, liberty is given to the Petitioner to challenge the aforesaid order at the time of framing of charge with further
// 2 // liberty that if he appears before the Court in seisin over the matter within six weeks hence and make a motion for bail, the Court in seisin over the matter shall release him on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper.
