1. The challenge in this petition is to an order dated 22nd July, 2009 passed by the Tahasildar, Bhubaneswr in Waste Land Case No. 1034 of 1978.

2. Admittedly, there is a remedy way of an appeal available to the Petitioner against the aforementioned order, before the SubCollector.

3. Consequently, leaving it open to the Petitioner to prefer such an appeal, this Court declines to entertain the present petition. If such appeal is filed not later than 2nd May, 2022 accompanied by an application for condonation of delay, citing the pendency of the present petition as the reason for the delay, such application shall be considered on merits by the Appellate authority. The Court clarifies that it has expressed no view on merits.
