Heard learned counsel for the Parties.

This is an application seeking for condonation of delay in filing of the appeal.

It is submitted by Mr. Behera, learned counsel for the Appellant that since the petitioner was suffering for the period from 25.03.2006 to 12.05.2007, so he could not file the appeal within the prescribed period of limitation. In support of the same, Mr. Behera with a memo has filed a medical certificate issued by the concerned doctor on 29.01.2010, which is much after filing of the present appeal.

Considering the submissions made, this Court is not inclined to condone the delay in filing the appeal.

Accordingly, the I.A. is rejected.

In view of the above, the appeal is also dismissed on the ground of limitation.
