Since the period of tender has already been over, by efflux of time, the writ petition has become infructuous. However, if the petitioner has any grievance with regard to refund of EMD, it is open to the petitioner to pursue its remedy before the appropriate forum in terms of the detail tender call notice or the agreement executed between the parties.

With the aforesaid liberty, the writ petition stands disposed of.
