Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Nikirei P.S. Case No.216 of 2021 corresponding to G.R. Case No.2676 of 2021 pending in the Court of learned S.D.J.M., Kendrapara for alleged commission of offences under sections 498A/307/323/34 of the Indian Penal Code read with section 4 of the D.P. Act.
Learned counsel for the petitioners submitted
// 2 // that the case has turned to one under section 302 of the Indian Penal Code in the meantime.
In view of the available material on record, the nature and gravity of the accusation, while not inclining to grant anticipatory bail to the petitioners, I direct that in the event the petitioners surrender and move for bail before the learned Court below within a period of four weeks from today, the same shall be disposed of as expeditiously as possible in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case diary be made available before the Court concerned for disposal of the case. The ABLAPL stands disposed of.
