This matter is taken up through Hybrid mode.

The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 26.09.2011 passed by the learned S.D.J.M., Titilagarh in I.C.C. No.16 of 2011 rejecting his petition under Section 205 of Cr.P.C. 3.

Considering the facts and submissions made, I am not inclined to quash the impugned order. Interim order dated 25.10.2011 passed by this Court stands vacated. 4.

However, since it is stated by the learned counsel for the petitioner that the petitioner is ready and willing to surrender and move bail before the Court in seisin over the

// 2 // matter, it is open to the petitioner to surrender before the Court in seisin over the matter within six weeks hence and if he surrenders and moves for bail, the Court in seisin over the matter shall allow him to go on bail on such terms and conditions as deemed just and proper.

A copy of this order be communicated to the Court below forthwith.

Urgent certified copy of this order be granted on proper application.
