Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 19.02.2020 in connection with Chandpur P.S. Case No. 133 of 2019 corresponding to G.R. Case No. 380 of 2019 pending in the Court of learned J.M.F.C., Ranpur for the alleged commission of offence under Section 395 of IPC.

It is submitted that the petitioner was remanded in this case on the basis of the statement of the co-accused, other co-accused persons, namely, Suni@Samir Khan and Sara@Serajuddin Khan have been released on bail as per orders passed by this Court in BLAPL No. 4898 of 2020 and BLAPL No. 6904 of 2021 respectively.

Considering the above facts and the period of detention of the
petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
