Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 01.07.2021 in connection with Jeypore Sadar P.S. Case No. 118 of 2021 corresponding to T.R. Case No. 51 of 2021 pending in the Court of learned Sessions Judge-cum-Special Judge, Koraput-Jeypore for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

It is submitted that the petitioner was allegedly escorting the vehicle in which contraband ganja weighing 50 kgs. was being transported but nothing was seized from his possession. The coaccused Basu Khemundu@Basu Mucham has been already been released on bail as per order passed by this Court in BLAPL No.
9670 of 2021.

Considering the submissions as above and the materials on record, I am inclined to allow the prayer or bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail. 6.
The BLAPL is accordingly disposed of.
