Heard learned counsel for the Parties.

For there is further development in the annulment of T.S. No.61/80, this Court finds, for this information not available for consideration in disposal of S.R.P. No.660/2004, no fault can be found with the Joint Commissioner, Settlement & Consolidation, Berhampur. Though the Writ Petition is declined to be entertained, this Court, however, observes, in the event any subsequent development, particularly, in annulment of the judgment and decree in T.S. No.61/80, nothing prevents the Petitioner to bring any fresh Proceeding under appropriate provision of law. 3.
With the above observation, the Writ Petition stands disposed of.
