This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to set aside the order dated 15th March, 2011 passed by the learned S.D.J.M., Balasore in 1.C.C. No.743 of 2009 wherein charge under Section 138 of N.I. Act has been framed against him, and consequently discharge him from the said charge.

No one appears on behalf of the Petitioner at the time of call. Learned counsel for the State-Opposite Party No.1 is present.

The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 7.

Interim orders dated 29th June, 2011 and 6th July, 2011 passed by this Court stands vacated.
