Heard Mr. S.K. Sanganeria, learned counsel for the petitioner and Mr. S.S. Pradhan, learned Addl. Govt. Advocate for the State.

This application has been filed for quashing the decision under Annexure-3, regarding select merit list of 9 candidates for the post of PET Contract Teacher in Jajpur Circle with a further prayer to direct the opposite parties to publish merit list of candidate as per advisement invited by the opposite party no.2 under Annexure-1 for the post of PET Contract Teacher in Jajpur Circle with consideration of 33% reserve for woman in all reserve category and consider the candidature of the petitioner. 4.

A memo has been filed by Mr. P.C. Nayak, learned counsel for the petitioner stating that the petitioner does not want to proceed further in the aforesaid writ petition, as such no instruction in this case. The same be kept on record. 5.

As the learned counsel for the petitioner has no instruction to proceed with the case and the writ application challenges the

select list in the year 2009-10, no useful purpose will be served by proceeding with this case.

The Writ Application is accordingly dismissed. 7.

Urgent certified copy of this order be granted on proper application.
