This matter is taken up through Hybrid arrangement (video conferencing/physical mode). None appears on behalf of the petitioner on repeated calls.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with C.T.

Case No.129 of corresponding to Jaleswar P.S. Case No.72 of 2018 pending in the Court of learned J.M.F.C., Jaleswar for alleged commission of offences under sections 363/109/34 of the Indian Penal Code.

Perused the F.I.R.

Learned counsel for the State on instruction

// 2 // submitted that though there was specific direction while granting interim protection to the petitioner that he shall appear before the Investigating Officer on 26th February, 2021 in between 10 to 2 p.m. and on such other date/s as asked for in order to cooperate with the investigation but the petitioner did not comply the order of this Court.

Since the petitioner has flouted the terms and conditions of the interim order, the anticipatory bail application stands dismissed.

Accordingly, the ABLAPL stands rejected.

The interim order dated 17.02.2021 stands vacated.
