1. None appears for the Opposite Party- Workman despite time being sought on his behalf on the previous date i.e., 22nd February, 2022.

2. The short ground on which the Management has in this petition, challenged an Award dated 17th September, 2009 of the Labour Court, Jeypore, Koraput in Industrial Dispute Misc. Case No.24 of 2008 is that the impugned order has been passed without affording the Petitioner an opportunity of being heard.

3. With there being no counter affidavit and with the Opposite Party-Workman choosing not to appear, the Court proceeds to set aside the impugned order and remands the aforementioned Industrial Dispute Misc. Case No.24 of 2008 of the Labour Court at Jeypore, Koraput, where it will now be listed for directions on 9th May, 2022.
