1. Learned counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to approach the Excise Commissioner against the impugned demand notice dated 23rd March 2012, issued by the Opposite Party No.3- Sub-Inspector of Excise, Kendrapara in accordance with law. If such petition is filed before 1st August 2022, accompanied by an application for condonation of delay, citing the pendency of the present petition as the reason for the delay, it will be considered by the Excise Commissioner in accordance with law and after hearing the Petitioner, a reasoned order shall be passed.
2. The writ petition is disposed of as withdrawn with liberty as prayed for in the above terms. An urgent certified copy of this order be issued as per rules.
