This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 6th September, 2010 passed by the learned Assistant Sessions Judge-cum-C.J.M., Balasore in S.T. No.15/26 of 1993 with further prayer to direct the trial court to proceed with both the cases i.e., G.R. No.1045 of 1991 (S.T. No.15/26 of 1993) and G.R. No.1053 of 1991 (S.T. No.29/119 of 1997) as counter to each other and accordingly deliver judgment successively one after another in conformity with the judgment passed in Criminal Revision No.17/96-95 passed by the learned Additional Sessions Judge, Balasore.

No one appears on behalf of the Petitioner when the matter is called. However, learned counsel for the StateOpposite Party is present. 4.

The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 7.

Interim order dated 22nd April, 2011 passed by this Court in Misc. Case No.777 of 2011 stands vacated. 8.

Order be communicated to the court concerned forthwith.
