This matter is taken up through hybrid mode.

This is an application filed by Opposite Party to recall the order dated 1st November, 2022 by which W.P.(C) No.3123 of 2012 was disposed of.

Mr. Mohanty, learned counsel for Opposite Party submits that the writ petition was listed on 1st November, 2022 for extension of the interim order granted vide order dated 15th March, 2012 passed in Misc. Case No.2686 of 2012 staying further proceedings of C.S. No.520 of 2008 pending before learned Additional Civil Judge (Senior Division), Puri. However, this Court took up the matter for final disposal in absence of learned counsel for Opposite Party and disposed of the writ petition on merit. It is further submitted that learned counsel for Opposite Party could not appear due to oversight of the matter in the cause list. It is also submitted that copy of I.A.

No.11757 of 2022 filed for extension of the interim order was not served on learned counsel for Opposite Party. 4.

Taking into consideration the submissions made by learned counsel for the parties, this Court feels that order dated 1st November, 2022 should be recalled.

Accordingly, order dated 1st November, 2022 is recalled and the writ petition is restored to file.

The I.A. is disposed of.
