CORAM:
THE CHIEF JUSTICE
ORDER
14.10.2022 Order No.
04.
1. The challenge in the present petition is to an order dated 26th December, 2015 passed by the learned Sessions Judge, Cuttack dismissing Criminal Revision No.44 of 2015. The jurisdiction exercised by the Sessions Judge was already a revisional jurisdiction. There cannot be a second petition Section 482 Cr PC seeking to challenge an order in a revision petition.
2. Be that as it may, on merits the Court finds that cogent reasons have been given by the Sessions Judge for rejecting the challenge to the order dated 9th November, 2015 passed by the S.D.J.M. (S), Cuttack in G.R. Case No.2039 of 2013 framing charges against the Petitioner for the offences under Sections 341 and 323 of IPC.
3. Consequently, the Court is not inclined to interfere in the matter. The petition is dismissed. The interim order passed earlier is hereby vacated.
4. A copy of this order be communicated forthwith to the concerned Subordinate Court.
