Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 19.09.2021 in connection with Junagarh P.S. Case No.314 of 2021 corresponding to C.T. Case No.307 of 2021 pending in the Court of learned Addl. Sessions Judge, Dharamgarh for the alleged commission of offence under Sections 147/148/302/294/323/506/149 of IPC.

Referring to the statement of the informant recorded under Section 161 Cr.P.C., it is submitted that there is clear evidence that the deceased himself was the aggressor which led to a quarrel, in course of which, he was assaulted and sustained fatal injuries.

Considering the submissions as above, materials on record and the statement of the witnesses recorded by the I.O., I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose
including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 6.
BLAPL is accordingly disposed of.
