This matter is taken up through hybrid mode.

The Petitioner being in custody in T.R. Case No.59 of 2018, arising out of P.R. Case No.24/2018-19 of Inspector of Excise, Khurda, pending in the court of 2nd Additional Sessions Judge-cum-Special Judge under NDPS Act, Khurda, has filed this petition for his release on bail. The offence alleged against him is punishable under Section 21(b) of the N.D.P.S. Act, 1985.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party.

The case is lingering as the Petitioner made a prayer to defer the cross-examination of prosecution witnesses, as revealed from the report of the learned 2nd Additional Sessions Judge, Khurda.

Hence, this Court is not inclined to release the Petitioner on bail on the ground of delay in deposal of the case.

Accordingly, the BLAPL stands dismissed.
