1. Learned counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to file an appeal and raise all the points urged by the present petition before the appellate authority in accordance with law. If such an appeal is filed not later than 1st June, 2022 accompanied by an application for condonation of delay, it will be considered on merits by the appellant authority in accordance with law, taking into account the delay on account of pendency of the present petition. It is clarified that the Court has not expressed any opinion on the merits of the case.
2. The interim order passed by this Court on 10th June, 2010 will continue till the appellate authority passes an appropriate interim order in the application to be filed with the appeal by the Petitioner provided it is filed within the time stipulated. The original
Annexures be returned to the Petitioner on being substituted by attested photocopies thereof.
3. The writ petition is disposed of in the above terms.
