Since the period of tender, i.e., for the year 2010-11 has already been over, by efflux of time, the writ petition has become infructuous.

Ms. S. Jena, learned counsel for the petitioner states that the petitioner is entitled to get refund of some amount in terms of the agreement. If that be so, liberty is granted to the petitioner to approach the appropriate forum in accordance with law. 4.

With the aforesaid liberty, the writ petition stands disposed of.
