This matter is taken up through virtual mode. Order No.

The Petitioners apprehending their arrest in Komna P.S. Case No.49 of 2012 corresponding to G.R. Case No.164(A) of 2012 pending in the court of J.M.F.C., Komna registered for alleged commission of offence punishable under Sections 302/201/34 IPC have filed this petition for their release on prearrest bail. 3.

Heard learned counsel for the Petitioners and learned counsel for the State.

This is a case of the year 2012. The Petitioners have been indicted in a case under Section 302 IPC. 5.

Considering the facts and the submission made, especially the nature of accusation, character of incriminating materials appearing against the Petitioners and the gravity of the offence and the circumstances in which the offences stated to have been committed, this Court is of the view that the

// 2 // Petitioners do not deserve to be released on pre-arrest bail more particularly when their custodial interrogation is required for collection of further evidence.

Accordingly, the ABLAPL stands rejected.

As restrictions due to resurgence of COVID-10 situation are continuing, learned counsel for the parties may utilize a printout copy of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021 and Court's Office order circulated vide Memo Nos.514 & 515 dated 7th January, 2022.
