1. The present writ petition has been filed questioning in the order dated 30th January, 2010 passed by the Principal Secretary to the Government, Law Department, Orissa, Bhubaneswar disposing of Misc. Case No.2 of 2009 arising out of Appeal No.6 of 2003 which in turn arose out of O.A.No32 of 1994. By the impugned order the prayer of the Petitioner that the Commissioner Endowments should give him preference to purchase 51 plots of land of the deity which were permitted to the sold, was declined.

2. The impugned order notes that "simply because the Petitioner is in possession of some plots of land and that even if accepted for a moment, law does not permit him to dictate that those be permitted to sold and that too giving him right as preferential purchaser."

3. Having heard learned counsel for the parties, the Court is unable to find any legal error having been committed by the authority in

passing the above order. Consequently, the Court is not inclined to interfere with the impugned order.

4. The writ petition is dismissed. No costs.
