IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.13393 of 2012 Jayanta Kumar Hembram ....
Petitioner None -versusChief Manager, State Bank of India, Angul, DistrictDhenkanal ....
Opposite Party Mr. D.P. Sarangi, Advocate for the Bank
CORAM:
JUSTICE JASWANT SINGH JUSTICE M.S. RAMAN Order No.
ORDER (Oral) 24.09.2022 11.
This matter is taken up through virtual/physical mode.
1. The prayer by the defaulting borrower in the present writ petition is for directing the State Bank of India, Angul Branch to lift the hold on the salary account so as to enable him to survive and also make payments towards outstanding loan installments.
2. Mr. Sarangi appearing for the Bank submits that the petitioner has since long died and the whereabouts of his L.Rs. are not known, hence the Bank has not been able to conclude the recovery process and close the loan account. It is further apparent that since the issuance of the notice, no interim stay was ever granted by this Court.
3. In view of the stand of the Bank, it can be safely construed that the petitioner or his L.Rs. were/are
// 2 // not interested in pursuing the writ petition. Perhaps by efflux of time, the present writ petition has also become infructuous.
4. In view of the above, the writ petition is dismissed as infructuous.
